Emergency responses for the supply of disinfectants against Covid-19

 

The COVID-19 pandemic calls for urgent policy responses to support the supply of disinfectant products such as hand sanitisers and wipes. The OECD is collecting and providing available information in countries to manage the emergency supply to increase availability of disinfectant products from different competent authorities and industry organisations. As the situation is fast evolving, countries are submitting information on a rolling basis.

Australia

Are there emergency procedures in place? 
The Australian Government has procedures in place which allow for the granting of emergency use authorisations. For example, the Australian Pesticides and Veterinary Medicines Authority (APVMA) has the authority to issue emergency use permits.
Have you identified adequate efficacy methods?  The Australian Government has guidance on Efficacy and Safety assessments of disinfectants. The information can be found here.
What products are approved? No disinfectant products regulated by the APVMA are specifically approved for the control of COVID-19.

The APVMA does approve sanitisers, these include exemptions for consumer disinfectants, reserved registration for specific disinfectants to treat inanimate objects with general claims and registration of specific products used for the treatment of specifically named microorganisms.

The APVMA database includes three registered disinfectants where there is a stated application method of ‘fumigation or fogging’. However these products have not been assessed for and are not specifically approved for the control of COVID-19.

Regulation of disinfectants in Australia is the responsibility of multiple government agencies, including Department of Health, National Industrial Chemicals Notification and Assessment Scheme (NICNAS) and the APVMA.

 

Belgium 

Are there emergency procedures in place? 
To face the shortage in disinfectant products, BE-CA has and is delivering temporary authorizations in accordance with Art.55(1) of the BPR. The procedure to apply for such derogation in Belgium can be found on our website on the dedicated page for Covid-19 (in French)
Have you identified adequate efficacy methods? 

In order to ensure that the product placed on the Belgium market are efficacious in the fight against Covid-19 spread, BE-CA has put in place specific requirements before granting the claim virucide for disinfectant products that can be find on our website on the dedicated page for Covid-19 (in French)

Efficacy:

  • Regarding products used for human hygiene purposes (product type 1), specifically hydroalcoholic gels or solutions
    - If the alcohol content is ≥70% (V/V), no efficacy tests are required.
    - If the alcohol content is <70% (V/V), an efficacy test is required according to norm EN 14476.

  • Regarding products used for the disinfection of surfaces (product type 2)
    Products with ethanol as an active substance:
    - If the ethanol content is <70% (V/V), an efficacy test is required according to norm EN 14476.
    - If the ethanol content is ≥70% (V/V), no efficacy tests are required.
  • Products with other active substances: Efficacy tests are required according to the following norms: EN 1276, EN 1650, EN 14476, EN 13697 (Bacteria & yeast).

What products are approved?

Most of the disinfectant products are not yet authorised under the Biocidal Product Regulation because the corresponding active substances have not yet been assessed and approved. Instead these products are available on the different national markets under the provision of the national legislations which vary widely: some countries have an authorisation system, others a simple registration system and some countries no specific provisions.

For the products authorised under the Biocidal Products Regulation, a search according to various criteria can be made on the ECHA website.

In Germany there are two biocidal product families with the active substance hydrogen peroxide which were authorised for PT 2 and the application method of vaporisation: Vaprox® 59 Hydrogen Peroxide Sterilant and VAPROX® HYDROGEN PEROXIDE STERILANT. The target organisms for each family are bacteria, fungi, viruses, yeasts and bacterial spores.

Furthermore there are biocidal products and biocidal product families for the application methods of fogging and fumigation which are on the market in the frame of transitional rules, for example the biocidal family The ANTI-GERM HYDROGEN PEROXIDE BASED DISINFECTANTS PRODUCT FAMILY PT4, PT5 for PT 4 (fogging and fumigation) and the biocidal product WESSOCLEAN GOLD LINE for PT 3 and 4 (fogging). The active substance for each is hydrogen peroxide.

The Technical Rules for Hazardous Substances (TRGS) available in German, reflect the state of technology, occupational safety and health and occupational hygiene as well as other definite knowledge relating to activities involving hazardous substances including their classification and labelling.

In Netherlands, there are disinfectants authorized for “misting” (Dutch: vernevelen) of closed spaces. The scale of the area is not defined, but the conditions of use make its use  impossible for larger public spaces, or spaces in the open, like malls, bus stations, or waiting rooms in airports: the treated area/space has to be sealed; no people can be present;  temperature has to be >20 C and RH >60%; and the area has to be cleaned and dried before application of the disinfectant.

United States 

Are there emergency procedures in place? 

US EPA activated the emerging viral pathogens policy on 29 January 2020 and announced that all submissions to add emerging viral pathogens claims would be expedited on 9 March 2020

US EPA announced a temporary amendment to an existing Pesticide Registration notice that allows registrants to notify EPA of certain formulation and manufacturing facility changes and immediately release the product for sale without waiting for EPA approval, in order to address reports of shortages of active ingredients used in surface disinfectants. 

US EPA has also announced a temporary enforcement discretion policy during the pandemic with regard to routine monitoring and reporting obligations.

US EPA is also considering emergency and crisis authorizations for COVID-19 under EPA section 18 authority.

During an outbreak of a new virus like COVID-19, no products exist on the market that can make claims to kill the virus. This is due to the simple fact that the virus was not available to test, and it can take more than one year to get a viral claim approved by a regulatory agency. For this reason, the United States EPA enacted a ‘hierarchy-based’ policy. This means that if a company’s product has been found to be effective against harder-to-kill viruses, it is likely to kill a virus like COVID-19.

A product that is likely to provide the greatest protection from COVID-19 will have claims against at least one non-enveloped virus such as Norovirus, Feline Calicivirus, Poliovirus, Rhinovirus, or Reovirus. This theory is the basis by which EPA has activated its Emerging Viral Pathogens Guidance for Antimicrobial Pesticides regulating registrants that claim their products are effective against COVID-19.

For standard biocide formulations (e.g. dilutable and ready-to-use disinfectants including pre-saturated wipes) the US EPA 810 guideline for disinfectants can be followed. This guideline specifies use of ASTM E1053. This method can be used to support claims specific for SARS-CoV-2. For other formulation types not covered by the disinfectant guideline, such as coatings, impregnated surfaces etc, US EPA does not have readily available methods but will work with interested registrants to approve a testing protocol as appropriate.

What products are approved?

US EPA maintains a list of disinfectants for use against SARS-CoV-2. This list is updated weekly to add new eligible products. At present, there are no products on the list that have been specifically tested against SARS-CoV-2. Eligibility criteria to be included on the list include registered disinfectants with approved claims for human coronaviruses or harder to kill, non-enveloped viruses in accordance with the agency Emerging Viral Pathogens policy.

The Center for Biocide Chemistries of the American Chemistry Council (CBC) has compiled a list of more than 1,000 ready-to-use, dilutable, and wipeable biocidal products that are approved by the U.S. Environmental Protection Agency (EPA) as effective at killing viruses like COVID-19.

The US EPA currently has 1 product on List N: Disinfectants for use against SARS-CoV-2 that has been evaluated as fogger (EPA Reg. No. 90150-2). This product is approved for room fogging and applied based on the size of the room. There are two additional products applied as vapors that are sterilants (EPA Reg. No. 72372-1 and 58779-4) and are also applied for whole room disinfection. This is subject to change as there is a great deal of interest in adding these types of application.

EPA does not recommend use of fumigation or wide-area spraying to control COVID-19. The Centers for Disease Control and Prevention (CDC) recommends that you clean contaminated surfaces with liquid products, such as those provided on List N, to prevent the spread of disease. Read CDC's recommendations here. Fumigation and wide-area spraying are not appropriate tools for cleaning contaminated surfaces.
