    Global Forum on Transparency and Exchange of Information for Tax Purposes Peer Reviews: Lesotho 2015 - Phase 1: Legal and Regulatory Framework

    The Global Forum on Transparency and Exchange of Information for Tax Purposes is the multilateral framework within which work in the area of tax transparency and exchange of information is carried out by over 120 jurisdictions which participate in the work of the Global Forum on an equal footing.The Global Forum is charged with in-depth monitoring and peer review of the implementation of the standards of transparency and exchange of information for tax purposes. These standards are primarily reflected in the 2002 OECD Model Agreement on Exchange of Information on Tax Matters and its commentary, and in Article 26 of the OECD Model Tax Convention on Income and on Capital and its commentary as updated in 2004, which has been incorporated in the UN Model Tax Convention.The standards provide for international exchange on request of foreseeably relevant information for the administration or enforcement of the domestic tax laws of a requesting party. 'Fishing expeditions' are not authorised, but all foreseeably relevant information must be provided, including bank information and information held by fiduciaries, regardless of the existence of a domestic tax interest or the application of a dual criminality standard.All members of the Global Forum, as well as jurisdictions identified by the Global Forum as relevant to its work, are being reviewed. This process is undertaken in two phases. Phase 1 reviews assess the quality of a jurisdiction’s legal and regulatory framework for the exchange of information, while Phase 2 reviews look at the practical implementation of that framework. Some Global Forum members are undergoing combined – Phase 1 plus Phase 2 – reviews. The ultimate goal is to help jurisdictions to effectively implement the international standards of transparency and exchange of information for tax purposes.

    Regulatory Policy in Lithuania - Focusing on the Delivery Side

    This review takes stock of the development and implementation of regulatory reform at a critical juncture for Lithuania. Confronted with the challenge of supporting growth and competitiveness, Lithuania has embarked upon an ambitious reform programme that addresses not only the development of new regulations but also the inspection and enforcement processes that support the effective implementation of these regulations with the least administrative burden for citizens and businesses. This is relatively rare among OECD members and the review assesses this comprehensive reform programme with a special focus on inspection and enforcement. First in its kind, the review benchmarks Lithuania's reforms against the OECD Best Practice Principles on Regulatory Enforcement and Inspection. The review identifies practical recommendations for strengthening regulatory effectiveness and support growth and competitiveness.

    Essai n° 421 : Essai de dépistage de la toxicité pour la reproduction et le développement

    La présente ligne directrice décrit les effets d'un produit chimique d’essai sur le fonctionnement de la reproduction chez le mâle et la femelle. Elle a été mise à jour par l'ajout de paramètres relatifs à la détection des perturbateurs endocriniens, en particulier la mesure de la distance ano-génitale et l’examen de la persistance du mamelon chez les petits, ainsi qu'un examen thyroïdien.

    La substance d’essai est administrée en doses graduées à plusieurs groupes de mâles et de femelles. Les mâles doivent être traités pendant un minimum de quatre semaines. Les femelles doivent être traitées tout au long de l’étude, soit approximativement 63 jours. Normalement des accouplements « un mâle pour une femelle » doivent être employés dans cette étude. Cette Ligne directrice utilise le rat. Il est recommandé que chaque groupe commence avec au moins dix animaux de chaque sexe. Généralement, au moins trois groupes d’essai et un groupe contrôle doivent être utilisés. Des niveaux de dose peuvent être basés sur l'information des essais de toxicité aiguë ou sur des résultats d’études à doses répétées. La substance d'essai est administrée oralement et quotidiennement. Les résultats de cette étude incluent des observations cliniques, la mesure du poids corporel et la consommation de nourriture/eau, la surveillance du cycle oestral, la mesure/observation des caractéristiques de la descendance, la mesure du taux sérique d'hormones thyroïdiennes, de même qu’une autopsie générale et l'histopathologie. Les résultats de cette étude de toxicité devraient être évalués en termes d'effets observés, autopsie et résultats microscopiques. En raison de la période courte du traitement du mâle, l'histopathologie du testicule et l'épididyme doivent être pris en compte avec les données de fertilité, lors de l’évaluation des effets reproducteurs mâles.

    Essai n° 478 : Essai de mutation létale dominante chez le rongeur

    L’essai de mutation létale dominante a pour but de détecter si certaines substances chimiques engendrent des mutations résultant d’aberrations chromosomiques dans les cellules germinales. En outre, l’essai de mutation létale dominante se prête bien à l’évaluation de la génotoxicité, car, malgré des variations entre les espèces, les facteurs du métabolisme in vivo, la pharmacocinétique et les processus de réparation de l’ADN sont actifs et contribuent aux réponses. L’apparition d’une mutation létale dominante à la suite d’une exposition à un produit chimique d’essai indique que cette substance a affecté le tissu germinal de l’animal étudié.La LD 478 initiale a été adoptée en 1984. La présente version modifiée de cette ligne directrice reflète plus de trente années d’expérience de cet essai et tient compte des possibilités de l’intégrer ou de le combiner à d’autres essais de toxicité, notamment pour le développement, la reproduction ou encore des essais de génotoxicité; cependant, étant donné les limitations de l’essai et le grand nombre d’animaux utilisés, cet essai n’a pas vocation à être utilisé en première intention, mais plutôt comme méthode d’essai supplémentaire quand il n’existe pas d’alternative pour satisfaire les exigences réglementaire.

    Test No. 240: Étude étendue de toxicité pour la reproduction sur une génération chez médaka (MEOGRT)

    Cette Ligne directrice décrit un essai de toxicité étendu au-delà d’une génération chez le médaka (Medaka Extended One Generation Test, MEOGRT). C’est un essai complet d’exposition visant à obtenir des données pouvant servir à l’évaluation des dangers et des risques pour l’environnement liés aux produits chimiques, en particulier les produits suspectés d’être des perturbateurs endocriniens (PE). L’exposition dans le test MEOGRT est poursuivie jusqu’à l’éclosion (jusqu’à deux semaines post-fécondation, spf) dans la seconde génération (F2). Plusieurs effets biologiques sont mesurés dans la présente Ligne directrice. Il s’agit en premier lieu de mettre en évidence les effets indésirables potentiels sur des paramètres pertinents en termes de population, tels que la survie, le développement macroscopique, la croissance et la reproduction. En second lieu, afin de disposer d’informations mécanistiques et de pouvoir établir des liens entre les résultats d’autres types d’études de terrain ou de laboratoire établissant a posteriori une activité potentielle de perturbation du système endocrinien (activité androgénique ou œstrogénique dans d’autres tests et essais, par exemple), on obtient d’autres informations utiles en mesurant l’ARNm de la vitellogénine (vtg) (ou la protéine vitellogénine, VTG) et des caractères sexuels secondaires (CSS) phénotypiques liés au sexe génétique, et en procédant à une évaluation histopathologique.

    Essai n° 404 : Effet irritant/corrosif aigu sur la peau

    Cette méthode fournit des informations sur les dangers pour la santé qui peuvent résulter d’une exposition à une substance d’essai solide ou liquide par voie dermique. Cette Ligne directrice recommande des stratégies séquentielles d'essai, qui incluent l'exécution d’essais in vitro ou ex vivo validés et admis pour la corrosion/irritation.

    Le lapin albinos est l’animal de laboratoire préférable. La substance à tester est appliquée en dose unique sur une petite surface de la peau (approximativement 6 cm²) d’un animal ; les surfaces non traitées de sa peau servent de contrôle. L’exposition est de 4 heures. Des résidus de la substance d’essai doivent ensuite être retirés. La dose appliquée sur le site d’essai est de 0.5 ml (liquide) ou de 0.5g (solide). La méthode consiste en deux essais : l’essai initial et l’essai de confirmation (employé uniquement s’il n’y a pas d’effet corrosif observé avec l’essai initial). Tous les animaux sont examinés pour les érythèmes ou les oedèmes pendant 14 jours. Les scores d'irritation dermique doivent être évalués en conjonction avec la nature et la sévérité des lésions, et leur présence ou absence de réversibilité. Quand des réponses persistent jusqu’à la fin de la période d’observation de 14 jours, la substance d’essai doit être considérée comme irritante.
